Means any restaurant, café, takeaway, food outlet, cloud kitchen, hospitality business, or food provider listed or operating through FOUGITO Services.

“Restaurant Partner”

Means a Restaurant that has entered into a commercial relationship with FOUGITO to receive orders, listings, promotional services, or technology solutions.

“Order”

Means a request submitted by a Customer through FOUGITO Services for food or related products supplied by a Restaurant.

“Content”

Means any information, material, or data displayed, uploaded, submitted, or published through FOUGITO Services, including:

• Text.
• Images.
• Videos.
• Menus.
• Reviews.
• Ratings.
• Business information.
• Logos.
• Promotional materials.

“Platform”

Means the technology systems operated by FOUGITO, including websites, applications, software, databases, and digital ordering infrastructure.

4. ACCEPTANCE OF THESE TERMS

By using FOUGITO Services, you agree:

• To comply with these Terms.
• To comply with all applicable UK laws and regulations.
• To provide accurate information when required.
• To use the platform responsibly and lawfully.

If you use FOUGITO Services on behalf of a business, company, restaurant, or organisation, you confirm that you have authority to accept these Terms on behalf of that entity.

5. ELIGIBILITY TO USE FOUGITO SERVICES

If you are using FOUGITO Services on behalf of another person or organisation, you confirm that you have permission and authority to do so.

6. ROLE OF FOUGITO

FOUGITO operates as a digital technology platform connecting:

• Customers;
• Restaurants;
• Hotels;
• Hospitality businesses.

FOUGITO provides technology services including:

• Online ordering systems.
• Digital menus.
• Restaurant discovery tools.
• Payment facilitation.
• Communication tools.

6.2 Restaurant Relationship

Unless expressly stated otherwise:

• Restaurants operate independently from FOUGITO.
• Restaurants are responsible for preparing and supplying food.
• Restaurants are responsible for food quality, safety, packaging, and fulfilment.

The contract for the supply of food is between:

Customer and Restaurant

FOUGITO acts as a technology facilitator.

6.3 No Food Supply

FOUGITO does not:

• Prepare food.
• Manufacture food products.
• Own restaurant kitchens.
• Control restaurant operations.
• Employ restaurant delivery staff.

7. CHANGES TO THESE TERMS

FOUGITO may update these Terms from time to time to reflect:

• Changes to our services.
• Changes in technology.
• Legal requirements.
• Business requirements.

Where changes are made:

• The updated version will be published on the FOUGITO website.
• The updated date will be displayed.
• Continued use of FOUGITO Services means you accept the updated Terms.

If you do not agree with updated Terms, you should stop using FOUGITO Services.

8. PROVIDING FOUGITO SERVICES

FOUGITO aims to provide reliable and continuously improving services. However, you acknowledge that:

Restaurants and businesses using FOUGITO Services confirm that:

• They have legal authority to represent the business.
• Business information provided is accurate.
• Menu information is correct.
• Prices are accurate.
• Licences and registrations required by law are maintained.

Businesses must promptly update information where changes occur.

11. ACCEPTABLE USE OF FOUGITO SERVICES

You agree not to:

• Use FOUGITO Services for unlawful purposes.
• Attempt to access systems without authorisation.
• Introduce viruses or malicious software.
• Use bots, scraping tools, or automated systems without permission.
• Interfere with platform operation.
• Copy or misuse FOUGITO technology.
• Misrepresent yourself or your business.
• Commit fraud or abuse.

FOUGITO may take action against users who breach these requirements.

12. RESTAURANT RESPONSIBILITIES

Restaurants listed or operating through FOUGITO Services remain independent businesses and are responsible for their own products, services, and operations.

Restaurants agree that they are responsible for:

• Food preparation.
• Food quality.
• Food safety.
• Packaging.
• Menu accuracy.
• Pricing accuracy.
• Allergen information.
• Order fulfilment.
• Customer service relating to food supplied.

12.1 Food Safety Compliance

Restaurants must comply with all applicable UK laws and regulations relating to food businesses, including:

• Food Safety Act 1990.
• Food Hygiene Regulations.
• Allergen information requirements.
• Environmental health requirements.
• Trading standards obligations.

Restaurants must maintain all licences, registrations, certificates, and approvals required for lawful operation.

12.2 Restaurant Information

Restaurants are responsible for ensuring that information displayed through FOUGITO Services is accurate, including:

• Business name.
• Address.
• Opening hours.
• Menu items.
• Prices.
• Ingredients.
• Allergen details.
• Images.
• Promotional information.

FOUGITO may assist with displaying information but does not guarantee that restaurant-provided information is always accurate or current.

12.3 Restaurant Independence

Restaurants operate independently from FOUGITO.

FOUGITO does not control:

• Restaurant staffing.
• Kitchen operations.
• Food preparation methods.
• Restaurant employment practices.
• Delivery arrangements unless expressly agreed.

13. HOW CUSTOMERS USE FOUGITO SERVICES

Customers may use FOUGITO Services to:

• Browse restaurants.
• View menus.
• Place orders.
• Make payments where available.
• Communicate with restaurants through approved channels.
• Submit reviews and feedback.

13.1 Order Placement

When placing an order through FOUGITO Services, you agree to provide:

• Accurate contact details.
• Correct delivery information.
• Complete order information.

Before submitting an order, you should check:

• Items selected.
• Quantity.
• Prices.
• Delivery details.
• Special instructions.

13.2 Order Acceptance

Submitting an order does not automatically guarantee acceptance.

An order is accepted when:

• The Restaurant confirms the order; or
• The Restaurant begins preparation.

Restaurants may reject orders due to:

• Item availability.
• Operating limitations.
• Technical issues.
• Other reasonable circumstances.

13.3 Contract for Food Supply

When a Customer places an order, the agreement for the supply of food is between:

Customer and the Restaurant

FOUGITO provides the technology platform that enables the transaction.

14. PRICING AND MENU INFORMATION

14.1 Restaurant-Controlled Pricing

Prices displayed on FOUGITO Services are provided and controlled by Restaurants. Restaurants are responsible for ensuring pricing information is accurate.

14.2 Price Changes

Restaurants may update:

• Menu prices.
• Item availability.
• Offers.
• Promotions.

The price confirmed at the time of order acceptance shall apply.

14.3 VAT and Charges

Where applicable:

• VAT may be included in displayed prices.
• Additional charges may apply, including delivery fees or service charges.

Any applicable charges will be displayed before order confirmation.

15. PAYMENTS

15.1 Payment Processing

Payments may be processed through third-party payment providers.

FOUGITO may facilitate payment processing but does not guarantee the operation of external payment systems.

15.2 Payment Information

FOUGITO does not normally store full payment card details.

Payment information may be processed securely by approved payment service providers.

15.3 Payment Authorisation

By placing an order, you authorise payment for:

• Applicable charges.

• Other charges displayed before confirmation.

16. DELIVERY

16.1 Restaurant Delivery Responsibility

Unless otherwise stated, Restaurants are responsible for:

• Preparing orders.
• Packaging orders.
• Delivering orders.
• Ensuring delivery quality.

16.2 Delivery Estimates

Delivery times shown through FOUGITO Services are estimates only.

Actual delivery times may vary due to:

• Restaurant workload.
• Customer location.
• Traffic conditions.
• Weather.
• External events.

16.3 Delivery Information

Customers must provide accurate:

• Address details.
• Contact information.
• Delivery instructions.

FOUGITO and Restaurants are not responsible for delays caused by incorrect information provided by Customers.

17. CANCELLATIONS AND REFUNDS

17.1 Customer Cancellation Requests

Customers may request cancellation before preparation begins.

Once a Restaurant has started preparing food, cancellation may not be possible because food products are prepared specifically for the Customer.

17.2 Eligible Refund Situations

Refunds, replacements, or credits may be considered where:

• The order was not received.
• Incorrect items were supplied.
• Items were missing.
• Food supplied was materially different from the description.
• There is another valid consumer rights issue.

17.3 Restaurant Responsibility

Where a complaint relates to:

• Food quality.
• Incorrect preparation.
• Missing items.
• Restaurant errors.

The Restaurant remains responsible for resolving the issue.

FOUGITO may assist communication between Customers and Restaurants.

17.4 Refund Processing

Approved refunds may take time to process depending on:

• Payment provider procedures.
• Banking timelines.
• Payment method used.

18. CUSTOMER RIGHTS

Nothing in these Terms affects your legal rights as a consumer under UK law.

This includes rights under applicable legislation, including:

• Consumer Rights Act 2015.
• Consumer Contracts Regulations 2013.

You may have additional rights depending on your circumstances.

19. PROMOTIONS AND DISCOUNTS

FOUGITO or Restaurant Partners may offer:

• Discount codes.
• Promotional offers.
• Special deals.
• Loyalty incentives.

Promotions may have:

• Specific eligibility requirements.
• Expiry dates.
• Usage limits.

FOUGITO and Restaurants reserve the right to withdraw or amend promotions where legally permitted.

20. CUSTOMER REVIEWS AND FEEDBACK

Customers may submit:

• Reviews.
• Ratings.
• Comments.
• Images.
• Feedback.

20.1 Review Requirements

Reviews must:

• Be genuine.
• Represent personal experience.
• Be accurate.
• Not contain unlawful content.

Customers must not submit:

• Fake reviews.
• Misleading information.
• Defamatory statements.
• Abusive or threatening content.

20.2 Content Moderation

FOUGITO may:

• Suspend accounts.

Restaurants must only use customer information for:

• Order fulfilment.
• Customer service relating to the order.
• Legal obligations

Restaurants must not use customer information for independent marketing unless:

21.4 Data Security

FOUGITO takes reasonable technical and organisational measures to protect personal information.

However, no internet-based service can guarantee complete security.

Customers should protect their account credentials and notify FOUGITO of suspected unauthorised access.

22. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights relating to FOUGITO Services belong to:

• FOUGITO; or
• Its authorised licensors.

This includes:

• Software.
• Applications.
• Website design.
• Logos.
• Trademarks.
• Branding.
• Graphics.
• Systems.
• Databases.
• Platform technology.

22.1 Limited User Licence

FOUGITO grants users a limited, personal, non-exclusive, non-transferable, and revocable right to access and use FOUGITO Services for their intended purpose.

22.2 Restrictions

You must not:

Restaurants retain ownership of their own:

• Images.
• Business information.

By providing content to FOUGITO, Restaurants grant FOUGITO a licence to use that content for:

• Displaying listings.
• Marketing the Restaurant through the platform.
• Operating FOUGITO Services.

23. ADVERTISING AND SPONSORED CONTENT

FOUGITO may display:

• Sponsored listings.
• Promotional placements.
• Advertisements.
• Featured restaurants.
• Partner promotions.

23.1 Sponsored Placement

Paid promotional placements may affect visibility or positioning within FOUGITO Services.

Where applicable, sponsored content may be identified.

23.2 Third-Party Advertising

Advertisements or promotions from third parties may appear through FOUGITO Services.

FOUGITO does not guarantee:

• Accuracy of third-party advertisements.
• Quality of advertised products.
• Availability of third-party offers.

Any transaction with advertisers is between you and the relevant third party.

• Menus and prices are controlled by Restaurants.
• Food preparation is performed by Restaurants.
• Delivery may be performed by Restaurants or third parties.

FOUGITO does not guarantee:

• Restaurant quality.
• Food suitability.
• Delivery performance.
• Availability of products.

30. LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded, including liability for:

• Death or personal injury caused by negligence.
• Fraud or fraudulent misrepresentation.
• Breach of statutory consumer rights.
• Any liability that cannot legally be excluded.

To the fullest extent permitted by law, FOUGITO shall not be responsible for:

• Restaurant actions.
• Food preparation.
• Food quality.
• Restaurant delivery failures.
• Third-party system failures.
• Losses caused by inaccurate information supplied by Restaurants.

31. INDEMNITY

You agree to compensate and protect FOUGITO, its officers, employees, partners, and affiliates against claims, losses, damages, and expenses arising from:

• Your breach of these Terms.
• Your unlawful use of FOUGITO Services.
• Your submitted content.
• Your violation of another person's rights.

This does not affect your statutory consumer rights.

32. NON-EXCLUSIVITY

FOUGITO Services operate on a non-exclusive basis.

FOUGITO may provide similar services to:

• Other restaurants.
• Hotels.
• Businesses.
• Customers.

Restaurants and businesses remain free to use other platforms unless separately agreed.

33. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of:

England and Wales

Any disputes shall be subject to the courts of England and Wales.

Where you are a consumer, you may also have rights to bring proceedings under applicable consumer protection laws.

34. GENERAL LEGAL TERMS

34.1 Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

34.2 No Waiver

Failure by FOUGITO to enforce any provision does not mean that FOUGITO waives the right to enforce it later.

34.3 Assignment

FOUGITO may transfer its rights and obligations under these Terms as part of:

• Merger.
• Corporate restructuring.

Users may not transfer their rights without written permission.

34.4 Entire Agreement
