Customer

How Customers Use Services

To access certain features of Fougito Services, you may be required to create and maintain a user account. All personal data provided during registration and use of the Services is handled in accordance with Fougito’s Privacy Policy.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted under your account.

When creating, claiming, or managing a business or restaurant listing, you confirm that all information provided is accurate, truthful, and complete, and you agree to keep it updated at all times.

If you create or manage an account on behalf of a business, you confirm that you are an authorised owner, operator, or legally permitted representative of that establishment.

You must not impersonate any person or entity, create accounts without authorisation, use false contact details, or claim listings that you are not legally entitled to manage. Such actions may result in immediate suspension or termination of access and may lead to legal action for any damages caused.

You remain fully responsible for all activities conducted through your Fougito Services account. You agree to notify Fougito promptly of any unauthorised access, security breach, or suspected misuse.

Sharing account access with third parties is strictly prohibited. You will be held accountable for any loss, misuse, or damage arising from unauthorised access or improper account sharing.

Other terms

You agree to access and use Fougito Services strictly for lawful purposes and in full compliance with these Terms, as well as all applicable rules, regulations, and legal requirements under the jurisdiction of the UK.

Fougito Services

Each restaurant available through Fougito Services operates independently under its own policies, pricing, and terms, with Fougito acting solely as a technology facilitator connecting customers and restaurants.

When you place an order using Fougito Services, you authorise Fougito to transmit your order details, preferences, and relevant information directly to the selected restaurant for preparation and fulfilment.

Services Pricing

All prices displayed across Fougito Services are set, managed, and supplied directly by the individual restaurants listed on the platform. Fougito does not control, regulate, or influence restaurant pricing structures.

While reasonable efforts are made to ensure pricing accuracy and timely updates, menu prices may change at the restaurant’s discretion based on internal policies, availability, or operational decisions.

In the event of any variation, inconsistency, or pricing discrepancy, the price confirmed by the restaurant at the time of order processing shall take precedence.

Fougito Services shall not be held responsible for unexpected price modifications, menu adjustments, or revisions implemented by restaurant partners.

General Terms and Conditions

Fougito does not prepare, manufacture, package, or sell any food or products displayed through Fougito Services.

The platform operates solely as a digital facilitator, enabling communication, order placement, and transaction processing between customers and participating restaurants.

All orders, preparation, fulfilment, and delivery services are executed exclusively by the respective restaurant.

Fougito Services are not liable for late deliveries, incorrect items, food quality concerns, menu inaccuracies, or pricing disputes.

Restaurants remain fully responsible and accountable for the products, services, and customer experience they provide.

When placing an order via Fougito Services, you agree to submit complete, accurate, and up-to-date contact and delivery information.

You are solely responsible for reviewing and confirming the accuracy of all provided details before order submission.

Where applicable, taxes are included in the final displayed price in accordance with local regulations.

Delivery time estimates are supplied by restaurants and may vary due to demand, operational constraints, or external factors.

Any promotional offers, discount codes, or incentives associated with Fougito Services are subject to specific terms and may be revised, suspended, or withdrawn at any time without prior notice.

Cancellation and refund policy

Customer-initiated cancellations after order confirmation may be treated as unauthorised reversals and could constitute a breach of order authorisation.

If an order is cancelled due to incorrect information, lack of response, or customer unavailability, you may be held liable for any resulting costs or losses.

Fougito Services reserve the right to recover liquidated damages equivalent to the total order value where applicable.

Refunds, credits, or replacements will only be processed upon explicit approval from the relevant restaurant partner.

If an order is cancelled by the restaurant or Fougito Services due to technical issues, item unavailability, or other valid operational reasons, no cancellation penalty will apply. Where payment has already been completed, eligible refunds will be issued directly by the restaurant in accordance with its internal policies.

Refund processing timelines are governed by your payment provider and may vary accordingly.

Special instructions submitted with orders will be communicated to restaurants and followed where reasonably possible; however, fulfilment cannot be guaranteed.

Disclaimer of warranties

You acknowledge and agree that Fougito Services are provided on an “as is” and “as available” basis.

Your use of the platform and its features is undertaken entirely at your own risk.

Fougito and its affiliates make no representations or warranties regarding uninterrupted access, error-free functionality, accuracy, reliability, or completeness of any services, content, or applications.

Limitation of liability

To the fullest extent permitted by law, Fougito shall not be liable for any indirect, incidental, special, or consequential damages resulting from your access to or use of Fougito Services.

This includes, but is not limited to, data loss, system interruptions, unauthorised access, inaccuracies in restaurant listings, pricing discrepancies, or technical failures.

Fougito Services are not responsible for property damage, service delays, financial loss, or inconvenience arising from third-party actions, restaurant operations, or external system dependencies.

Indemnification

You agree to indemnify, defend, and hold harmless Fougito, its officers, employees, affiliates, and partners from any claims, liabilities, losses, damages, or expenses arising from your use of Fougito Services, your submitted content, or any violation of these Terms.

Fougito retains the exclusive right to assume control and defence of any matter subject to indemnification.

You agree not to resolve or settle any such claim without prior written consent from Fougito.

Reasonable efforts will be made to notify you promptly of any related claim, action, or proceeding.

End of access to service

You may request account deactivation at any time by contacting official Fougito support channels.
